Navigating Proposition 65 Compliance

California's Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65) requires businesses to inform the public about exposure to chemicals known to cause cancer, birth defects, or other reproductive harm through their products.

With over 1,000 chemicals on the Proposition 65 List, manufacturers must collect detailed chemical data, evaluate exposure risks, and meet strict warning label requirements. Failure to comply can result in lawsuits and penalties of up to $2,500 per violation (per exposed person), per day.

Managing these requirements internally can be overwhelming, time-consuming, and prone to error.

We collect supply chain data for you

We contact your suppliers directly to collect data on the presence of Prop 65 regulated substances in your parts and components so that you can take the necessary steps toward compliance.

Hands-On Data Collection & Validation

GreenSoft collects chemical substance data from your suppliers on your behalf and validates it for accuracy and completeness using a multi-step validation process.

Prop 65 Screening

Our partner RegTox Solutions, evaluates flagged risks and conducts detailed exposure analyses to determine if your products require warning labels.

Prop 65 Warning Label Requirements

Proposition 65 requires businesses to provide “clear and reasonable” warnings if their products or business locations expose Californians to harmful chemicals.

Following amendments made in 2018, affected businesses must now provide more detailed and accurate labels, moving beyond the general Proposition 65 warning label. The warnings must now identify which product or location exposes the public to the regulated chemicals, and identify at least one of the chemicals to which the public would be exposed.

This makes collecting detailed chemical data on your products essential for Prop 65 compliance.

Noncompliance with California Prop 65 has severe consequences

Failing to provide the required warnings or accurately assess chemical exposure can lead to costly lawsuits, with penalties reaching up to $2,500 per violation (per exposed person), per day.

These lawsuits can be filed not only by the California Attorney General’s Office but also by private citizens and “bounty hunter” lawyers acting in the public interest.

Beyond financial penalties, noncompliance can damage your company’s reputation and erode consumer trust, potentially affecting sales and business relationships. Ensuring compliance is essential to avoid these legal and financial risks.
