At times, the RoHS and REACH European Union (EU) regulations can overlap in their applications. REACH is “horizontal legislation” that applies across all applicable industries, including electrical and electronic equipment (EEE), which is already covered under RoHS.
The EU published a Common Understanding paper yesterday to clarify what manufacturers need to do when these two regulations overlap. The paper details which regulation manufacturers should default to in six specific overlap situations.
The overall conclusion is that manufacturers should give priority to RoHS regulations over REACH regulations as much as possible for EEE when the two regulations overlap.
The EU paper states that the two regulations are complimentary and are meant to work together, but that the Commission understands that further clarification was needed. The full document can be read here.
