1 in 4 Imported Products Found to be Non-Compliant with EU REACH and CLP

ECHA’s Enforcement Project Finds 1 in 4 Products Not In Compliance With EU REACH and CPL

EU-REACHThe European Chemicals Agency (ECHA) released new results from the agency’s ongoing Enforcement Project which found that 23% of imported products are non-compliant with the EU REACH and Classification, Labelling and Packaging (CLP) regulations.

ECHA examined nearly 1,400 products in 16 EU Member States and found that over 300 products (23%) were non-compliant with certain obligations under REACH and CLP.

The products were checked at strategic entry points in EU Member State countries, such as airports and harbors, as well as inland customs offices.

The checks focused on the presence of cadmium, lead and nickel in articles, which are restricted substances under the REACH regulation. Of the 1,225 checks for restricted substances, 17% of the products had amounts of the restricted substances above the required limit.

ECHA noted in the reports that the results “show that importers need to intensify their efforts to supply safe products which are compliant with REACH and CLP.” ECHA also stated that “there is a continued need for targeted enforcement on these specific restrictions and more stringent enforcement of REACH and CLP at European points of entrance.”

SCIP Database Submissions Remain Due in January as ECHA Confirms No Delay will be Issued

The Deadline For SCIP Database Submissions Will Remain Due January 2021

scipChemical Watch has reported that the European Commission and the European Chemicals Agency (ECHA) have confirmed the notification requirements under the SCIP Database will proceed as planned, despite industry groups requesting a delay.

In September, the IPC Association and 40 industry groups called on European Commission President Ursula von der Leyen to postpone the January deadline for the SCIP Database and to study related issues further before it goes forward.

The Commission did not directly confirm whether or not President von der Leyen received or considered the delay request, but did state that the January 5, 2021 deadline to begin submitting information to the SCIP Database still stands.

2 Substances Proposed to be Added to EU REACH SVHC Candidate List

Awaiting Decision On 2 Substances for Inclusion In The EU REACH SVHC Candidate List

EU-REACHTwo substances have been proposed to be added to the EU REACH Substances of Very High Concern (SVHC) Candidate List.

The substances will be considered by the European Chemicals Agency (ECHA) during a consultation period, and interested parties may submit comments on the proposed substances during this time. The deadline to submit comments is October 10.

ECHA is expected to announce the final decision about the inclusion of these substances in December, and the inclusion of the substances on the EU REACH SVHC Candidate List will take immediate effect at that time.

The two substances proposed for inclusion are:

Alarm Clock Removed From Amazon Due To RoHS Violation

Alarm clock in violation of EU RoHS due to excessive levels of Mercury

eu-rohsA digital alarm clock has been removed from Amazon.com for failure to comply with the EU RoHS Directive.

The EU Member State of Germany submitted the alert concerning the digital alarm clock. The alarm clock is manufactured in China.

The alarm clock contains a tilt switch filled with approximately 10 µl of Mercury. The enforcement action alert notes that users could be exposed to the mercury in the event that the product gets damaged.
