6 New Substances Added to the CA Proposition 65

OEHHA adds new chemicals to the CA Proposition 65

prop-65Six substances were added to the list of chemicals known to the state of California to cause cancer under the Safe Drinking Water and Toxic Enforcement Act of 1986 (CA Proposition 65).

The Office of Environmental Health Hazard Assessment (OEHHA) added the following chemicals effective September 13, 2019:

The six substances are raw materials that are commonly used to create chemical compounds.

Companies affected by California Proposition 65 are required to warn customers of potential exposure to the substances known to the state of California to cause cancer or reproductive harm.

The notification requirements were updated in August 2018. Among other changes, affected companies must now identify at least one regulated chemical that a specific product or location causes exposure to, as opposed to the previous general practice of simply warning of the presence of chemicals.

The list of these regulated substances is ever-changing and growing. The last prior addition to the regulated substances list was July 2019.

ECHA publishes data requirements for new EU REACH database (SCIP)

The ECHA publishes data requirements for new EU REACH SVHC Database

scipThe European Chemicals Agency (ECHA) has released the data requirements for the upcoming EU REACH Substances of Very High Concern (SVHC) database that will be launched by the organization in early 2020.

The database, known as SCIP, will contain information on "Substances of Concern in articles, as such or in complex objects (Products)."

Companies placing articles on the EU market which contain reportable levels of SVHCs will need to submit their product information into the SCIP database starting January 5, 2021.

Suppliers of articles will need to submit the following information to the SCIP database:

  • Information that allows the article to be identified
  • The name, concentration range, and location of the SVHC in the article
  • Information on the safe use of the article, including during disposal
  • Material Category of the material containing the SVHC

EU RoHS Additional Restrictions Take Effect Today

4 new phthalate substances are regulated under EU RoHS starting today

July 21, 2019 is the effective date for the addition of four substances to be regulated under EU RoHS. 

Bis(2-ethylhexyl) phthalate (DEHP), Butyl benzyl phthalate (BBP), Dibutyl phthalate (DBP), and Diisobutyl phthalate (DIBP) are now included in the list of substances restricted under EU RoHS. 

The substance restrictions apply for all electrical and electronic equipment categories except medical devices and monitoring and control equipment, which have until July 2021 to become compliant.

EU RoHS Category 11 comes into scope for remaining electrical and electronic equipment today

Additionally, the final category of electrical and electronics equipment (EEE) products under EU RoHS come into scope today. EU RoHS Category 11 applies to all EEE products not covered in Categories 1 through 10, which are listed here.

Effective 21 July 2019, manufacturers and distributors of Category 11 products cannot apply the CE-Mark or otherwise offer their products for sale within the EU unless they have been validated and confirmed to comply with the substance restriction requirements of the EU RoHS Directive.

4 New Substances Added to EU REACH SVHC List

EU REACH SVHC Candidate List now has 201 substances

EU-REACHThe European Chemicals Agency (ECHA) has announced the addition of 4 substances to the EU REACH Substances of Very High Concern (SVHC) Candidate List. The SVHC Candidate List now contains 201 substances.

The substances added to the SVHC Candidate List effective July 16, 2019 are:

  1. 2-methoxyethyl acetate for the reason of being toxic for reproduction (Article 57c)
  2. Tris(4-nonylphenyl, branched and linear) phosphite (TNPP) with ≥ 0.1% w/w of 4-nonylphenol, branched and linear (4-NP) for the reason of having endocrine disrupting properties (Article 57(f) – environment)
  3. 2,3,3,3-tetrafluoro-2-(heptafluoropropoxy)propionic acid, its salts and its acyl halides (covering any of their individual isomers and combinations thereof) for the reason of having probable serious effects to the environment (Article 57(f) - environment), and probable serious effects to human health (Article 57(f) – human health)
  4. 4-tert-butylphenol for the reason of having endocrine disrupting
    properties (Article 57(f) – environment)

Companies may have legal obligations resulting from the inclusion of any substance in the SVHC Candidate List. These obligations may apply to the listed substance on its own, in mixtures, or in articles. Any supplier of articles containing an SVHC above a concentration of 0.1 % (weight by weight) has communication obligations towards customers down the supply chain and consumers.

New Substance Added to California Prop 65: PCBTF

PCBTF has been added to the California Proposition 65 chemicals list

prop-65In June, the Office of Environmental Health Hazard Assessment (OEHHA) added p-chloro-α,α,α-trifluorotoluene (para-Chlorobenzotrifluoride, PCBTF) to the list of chemicals known to the State of California to cause cancer under the Safe Drinking Water and Toxic Enforcement Act of 1986 (CA Proposition 65).

Substances added to the CA Proposition 65 regulated chemicals list are subject to requirements which include exposure notification and warning labels. These notification and label requirements were recently updated in August 2018.

PCBTF is a solvent often used in coatings, and has a wide range of applications including the manufacture of printing inks, cleaners, degreasing agents, aerosols, paints, adhesives, caulks, epoxies, and urethanes.

The addition of PCBTF to the CA Proposition 65 list of chemicals known to cause cancer is effective June 28, 2019:

EU RoHS Additional 4 Substance Restrictions Take Effect in July

Here's what you need to know about the 4 substances added to EU RoHS starting July 2019

eu-rohsIn June 2015, the European Commission announced the addition of four phthalate substances to be regulated under EU RoHS in 2019.

The substance restrictions take effect this July for all electrical and electronic equipment categories except medical devices and monitoring and control equipment, which have until July 2021 to become compliant.

The four restricted substances are:

- Bis(2-ethylhexyl) phthalate (DEHP)

- Butyl benzyl phthalate (BBP)

- Dibutyl phthalate (DBP)

- Diisobutyl phthalate (DIBP)

Note that while the EU RoHS regulation with the four new substances is sometimes referred to within the industry as “RoHS-3,” it is still officially considered the "RoHS-2" regulation by the European Commission. The "RoHS-2" regulation has not been changed to a new version of "RoHS-3," rather, four new substances have been added to "RoHS-2."
