New Substance Added to California Prop 65: PCBTF

PCBTF has been added to the California Proposition 65 chemicals list

prop-65In June, the Office of Environmental Health Hazard Assessment (OEHHA) added p-chloro-α,α,α-trifluorotoluene (para-Chlorobenzotrifluoride, PCBTF) to the list of chemicals known to the State of California to cause cancer under the Safe Drinking Water and Toxic Enforcement Act of 1986 (CA Proposition 65).

Substances added to the CA Proposition 65 regulated chemicals list are subject to requirements which include exposure notification and warning labels. These notification and label requirements were recently updated in August 2018.

PCBTF is a solvent often used in coatings, and has a wide range of applications including the manufacture of printing inks, cleaners, degreasing agents, aerosols, paints, adhesives, caulks, epoxies, and urethanes.

The addition of PCBTF to the CA Proposition 65 list of chemicals known to cause cancer is effective June 28, 2019:

EU RoHS Additional 4 Substance Restrictions Take Effect in July

Here's what you need to know about the 4 substances added to EU RoHS starting July 2019

eu-rohsIn June 2015, the European Commission announced the addition of four phthalate substances to be regulated under EU RoHS in 2019.

The substance restrictions take effect this July for all electrical and electronic equipment categories except medical devices and monitoring and control equipment, which have until July 2021 to become compliant.

The four restricted substances are:

- Bis(2-ethylhexyl) phthalate (DEHP)

- Butyl benzyl phthalate (BBP)

- Dibutyl phthalate (DBP)

- Diisobutyl phthalate (DIBP)

Note that while the EU RoHS regulation with the four new substances is sometimes referred to within the industry as “RoHS-3,” it is still officially considered the "RoHS-2" regulation by the European Commission. The "RoHS-2" regulation has not been changed to a new version of "RoHS-3," rather, four new substances have been added to "RoHS-2."

CA Proposition 65 Clarification on Nickel (Soluble Compounds) Released by OEHHA

OEHHA Releases Definition of Nickel (Soluble Compounds) for CA Proposition 65 Regulation

In October 2018, the Office of Environmental Health Hazard Assessment (OEHHA) added Nickel (soluble compounds) to the list of chemicals known to the state of California to cause reproductive toxicity under the Safe Drinking Water and Toxic Enforcement Act of 1986 (CA Proposition 65).

Prior to this, the list of chemicals regulated under CA Proposition 65 contained a listing for nickel compounds, which was added to the list in May 2004.

Following the October 2018 listing of nickel soluble compounds, the industry requested guidance from OEHHA on the definition of Nickel (soluble compounds) vs. the definition of Nickel compounds.

On May 2, OEHHA released an announcement to clarify and define Nickel (soluble compounds) as regulated under CA Proposition 65:

For purposes of Proposition 65, Nickel (soluble compounds) are defined to be compounds of nickel with solubility in water of greater than 0.1 moles per liter (mol/L) at 20°C.

Nickel (soluble compounds), also known as Nickel salts, are used in electroplating baths and batteries, but are not normally present in finished electronic products in a manner which would provide exposure requiring a CA Proposition 65 warning.

The main concern for Nickel exposure facing electronics producers is external Nickel plated surfaces, which can provide unsafe levels of skin contact exposure in some limited applications.

New Version CMRT 5.12 for Conflict Minerals Reporting Released

Conflict Minerals Reporting Template (CMRT) Version 5.12 Released by the Responsible Minerals Initiative (RMI)

The Responsible Minerals Initiative (RMI) organization has released an updated Conflict Minerals Reporting Template (CMRT) version: CMRT 5.12.

CMRT forms are used to exchange conflict minerals data across the supply chain in order to comply with the US Conflict Minerals regulation.

CMRT forms are updated and released once or twice per year by the RMI organization. The last CMRT update was version 5.11 in April 2018, and RMI anticipates the next version will be released in Spring 2020.

The new CMRT 5.12 can be downloaded from the RMI website here.

Major changes to CMRT 5.12 include:

  • Corrections to all bugs and errors
    • Update to ISO country, state and province lists
  • Enhancements which do not conflict with IPC-1755
  • Updates to the Smelter Reference List and Standard Smelter List

Electronic Equipment Under EU RoHS Category 11 Must Comply on 21 July 2019

EU RoHS Category 11 comes into scope on 21 July 2019 affecting all remaining electrical and electronic equipment (EEE)

eu-rohsThe EU RoHS Directive restricting the use of hazardous substances in electrical and electronic equipment (EEE) has been in force since June 2006. However, the requirements of EU RoHS have been applied to producers of electronic equipment gradually as various EEE categories have come into scope piece by piece over the years.

On 21 July 2019, the final category of EEE products under EU RoHS will come into scope. EU RoHS Category 11 applies to all EEE products not covered in Categories 1 through 10.

Effective 21 July 2019, manufacturers and distributors of Category 11 products cannot apply the CE-Mark or otherwise offer their products for sale within the EU unless they have been validated and confirmed to comply with the substance restriction requirements of the EU RoHS Directive.

EU RoHS categories and category overlap

If an EEE product is not included in EU RoHS Categories 1 through 10, then it is considered part of Category 11. This means the 21 July 2019 effective date affects all remaining electronic equipment not yet in scope with EU RoHS.

The following is a list of all the categories covered by Annex I of the EU RoHS Directive:

  1. Large household appliances.
  2. Small household appliances.
  3. IT and telecommunications equipment.
  4. Consumer equipment.
  5. Lighting equipment.
  6. Electrical and electronic tools.
  7. Toys, leisure and sports equipment.
  8. Medical devices.
  9. Monitoring and control instruments including industrial monitoring and control instruments.
  10. Automatic dispensers.
  11. Other EEE not covered by any of the categories above.

Some examples of Category 11 products include: 2-wheeled electric vehicles; electronic nicotine delivery systems (ENDS) such as e-cigarettes, cannabis vaporizers and vape pens; electrical cables that are less than 250V working voltage; and non finished cables such as cable reels without plugs.

Three Substances Proposed to be Added to the EU REACH SVHC List

ECHA is holding a consultation period on the proposal to add three new substances to the EU REACH SVHC Candidate List

EU-REACHLast week, the European Chemicals Agency (ECHA) announced the start of a consultation period to evaluate proposals to add three substances to the EU REACH regulation Substances of Very High Concern (SVHC) Candidate List.

The substances proposed for inclusion on the SVHC List are:

  1. 2,3,3,3-tetrafluoro-2-(heptafluoropropoxy)propionic acid, its salts and its acyl halides (covering any of their individual isomers and combinations thereof) for the reason of having probable serious effects on the environment (Article 57f) and having probable serious effects on human health (Article 57f)
  2. 2-methoxyethyl acetate for the reason of being toxic for reproduction
  3. Tris(4-nonylphenyl, branched and linear) phosphite (TNPP) with ≥ 0.1% w/w of 4-nonylphenol, branched and linear (4-NP) for the reason of having endocrine disrupting properties (Article 57(f) – environment)

The consultation period for interested parties to submit comments to ECHA related to uses, volumes per use, exposure, alternatives and risks of the substances started on 13 March and ends on 29 April 2019. Information on the substance proposals and consultation period can be found on the ECHA website.

If the substances do become recommended for inclusion on the SVHC List, affected companies using the substances in their products will become subject to the substance limits and other requirements of the EU REACH regulation. The official recommendation for inclusion would likely come in June or July of this year, and would bring the SVHC list up to 200 substances.

reach-article-webinarWe recently hosted a webinar on the changes to the definition of an "article" under the EU REACH regulation: "Solving the EU REACH 'Once an Article, Always an Article' Problem."

Hosted by Randy Flinders, this webinar explained the ruling by the European Court of Justice that changed the method for calculating EU REACH Substances of Very High Concern (SVHC) levels in articles. Randy provided case studies and detailed examples of article calculations using the new article definition.

The webinar also provided a peak into our GreenData Manager software which has been updated to deal with the challenges of this regulation change. Under the new definition of an article, companies need to evaluate SVHCs at the article level of a component or product rather than at the component or product level. GreenData Manager software now allows users to dynamically apply article designations for each material present in a part, and has the capability to process complex articles made of multiple materials within the part so that users can comply with the regulation changes.
