SOR_ValidationIn June, we announced our latest Data Service for Conflict Minerals compliance: Smelter or Refiner (SOR) Validation.

Now we're releasing a detailed data sheet on this service to explain our comprehensive SOR validation process, and how it can release suppliers from the burden of contacting multiple suppliers, sub-suppliers, and even smelters or refiners directly.

In order to validate the compliance status of SORs listed by supplier disclosures in support of the conflict minerals provision of the Dodd-Frank Act, direct contact with suppliers and SORs is required. With language barriers, time zone differences, and frequently unresponsive suppliers, this process can be very time consuming and frustrating for electronics manufactures.

GreenSoft's SOR Validation service will handle the validation for you, including communicating with your supply chain for document gathering and validating the supplied information across databases such as CFSI/CFSP and LBMA/RJC/DMCC.

Korea Releases First List of 510 Substances Regulated Under K-REACH

k-reachSouth Korea's Ministry of Environment (MoE) released their first priority existing chemicals (PEC) list to the Korean Gazette on July 1. The list contains 510 substances subject to Korea's Act on the Registration and Evaluation of Chemicals (K-REACH).

Manufacturers or importers of the 510 substances in amounts exceeding one ton per year are required to register their use of the substances before July 1, 2018.

ECHA Shortlists 200 Substances for Possible REACH Restrictions

ECHAOn June 25, the European Chemicals Agency (ECHA) selected approximately 200 substances from the REACH registrations for further scrutiny to decide whether there is a need for regulatory action, such as compliance check, substance evaluation, harmonized classification and labeling, authorization or restriction.

The list of these 200 substances has not been released. The selection is based on an automated screening focusing on substances with potential CMR (carcinogenic, mutagenic or toxic to reproduction), PBT (persistent bioaccumulative toxic), endocrine disrupting or sensitizing properties. Substances are then further prioritized based on uses that are likely to lead to exposure to humans or release to the environment.

The 200 substances shortlisted are registered by 800 companies, which will soon receive a letter from ECHA informing them of the on-going examination of their registrations. These companies are invited to update their dossier to address any shortcomings, as up-to-date information will help the Member State authorities better assess whether the concern indicated by the screening is confirmed, and whether regulatory action is still considered appropriate.

4 New Phthalate Substances Added to RoHS-2 Annex II

eu-rohsOn June 4, the European Commission announced that four new phthalate substances have been added to the restricted substances list under Annex II of the EU RoHS-2 Directive on March 31.

The new substance restrictions take effect in July 2019 for all electrical and electronic equipment categories except medical devices and monitoring and control equipment, which have until July 2021 to become compliant.

The RoHS-2 regulation with the four new substances is sometimes referred to within the compliance industry as "RoHS-3," although it is still officially considered the RoHS-2 regulation by the European Commission.

The four new restricted substances are:

  • Bis(2-ethylhexyl) phthalate (DEHP)
  • Butyl benzyl phthalate (BBP)
  • Dibutyl phthalate (DBP)
  • Diisobutyl phthalate (DIBP)

The EU had notified the World Trade Organization (WTO) in December to expect these RoHS-2 Annex II additions, but at the time the EU expected an official announcement in February or March instead of June.

2 New Substances Added to REACH SVHC Candidate List

ECHAToday the European Chemicals Agency (ECHA) added two new substances to the REACH Substances of Very High Concern (SVHC) Candidate List. The list is now up to 163 substances.

With the inclusion of the substances on the SVHC Candidate List, manufacturers and importers of products containing the substances now have six months from today to notify ECHA if they continue to use the substances.

The two newly added substances are:

  1. 1,2-benzenedicarboxylic acid, di-C6-10-alkyl esters; 1,2-benzenedicarboxylic acid, mixed decyl and hexyl and octyl diesters with ≥ 0.3% of dihexyl phthalate (EC No. 201-559-5)
  2. 5-sec-butyl-2-(2,4-dimethylcyclohex-3-en-1-yl)-5-methyl-1,3-dioxane [1], 5-secbutyl-2-(4,6-dimethylcyclohex-3-en-1-yl)-5-methyl-1,3-dioxane [2] [covering any of the individual stereoisomers of [1] and [2] or any combination thereof]

CFSI Jumps to CMRT 4.01 Forms to Correct Errors

The Conflict Free Sourcing Initiative (CFSI), an initiative of EICC and GeSI, released a new Conflict Minerals Reporting Template (CMRT) version today: CMRT 4.01.

The new CMRT 4.01 form comes just a few months after CFSI released the CMRT 4.0 form on April 30 this year.

CMRT 4.01 makes the following changes, none of which affect the function of 4.0:

  • The new CMRT 4.01 forms include an updated smelter list.
  • Declaration: requests additional information even when checker has been completed (i.e., message in cell I3 does not turn off)
  • Smelter list: tungsten turns red if the last two options from the pick list are chosen
  • Checker: bottom three rows only turn green if tantalum turns green

China RoHS Gets Its Recast: What You Need to Know About China RoHS-2

china-rohsOn May 18, China’s Ministry of Industry and Information Technology (“MIIT”) released a draft version of their revised China RoHS legislation for public comments. The public-comment period ends June 17, and the new China RoHS-2 draft may be further revised before it becomes official law later in the year.

The legislation is formally named “Management Methods for the Restriction of the Use of Hazardous Substances in Electrical and Electronic Products” and full text is available from the MIIT website. Access to the full English translation is available from Foley & Lardner LLP.

The existing China RoHS-1 legislation established content limits for hazardous substances, and labeling and information disclosure requirements. The labeling and disclosure requirements have been in place since March 2007, but the content limit requirements have not been implemented.

The draft China RoHS-2 legislation would make several changes, including:

  • Applying content limits for hazardous substances to the electrical and electronic products listed in the “Compliance Management Catalogue,” a to-be-developed list of electronic and electrical products that will be issued in successive batches over the duration of the program
  • Modifying the “compulsory certification” approach in China RoHS-1 for a potentially more flexible “conformity assessment system”
  • Removing the “products manufactured for export” exemption included in China RoHS-1
  • Expanding or adjusting the scope of labeling and information-disclosure requirements
  • Excluding power generation, transmission and distribution equipment from the definition of “electrical and electronic products”
  • Re-introducing packaging material standard conformity requirements that had been removed in earlier drafts

What China RoHS-2 Means for GreenSoft Clients
China RoHS-2 is not final. The new catalog is still under development and the new "conformity assessment system" is still to be defined. GreenSoft will monitor developments closely and when the regulation is final GreenSoft's customers will be notified by their dedicated Project Manager immediately to discuss the changes and implications.

EU Parliament Votes for Mandatory Conflict Minerals Certification

european-commissionAfter an EU Parliament Commission voted last month to move forward with draft Conflict Minerals legislation, the full EU Parliament voted yesterday to amend the draft legislation and make the certification of conflict minerals imports mandatory instead of self-certified.

In a 400 to 285 vote, the Parliament overturned the Commission's self-certification proposal by requesting mandatory compliance for all European Union importers sourcing from conflict areas, and required that importers or manufacturers obtain information from downstream suppliers on the steps taken to identify and address risks in the supply chain for conflict minerals.

The Parliament also voted for more frequent monitoring and review of the legislation, every three years instead of every six years, and requested financial support for small or medium-sized businesses wishing to obtain certification through the EU's Competitiveness of Enterprises and Small and Medium-Sized Enterprises (COSME) program.

The next step for Parliament is to enter into informal talks with EU member states to come to an agreement on the final version of the legislation.
