CFSI Releases Conflict Minerals Reporting Template (CMRT) Version 4.0

The Conflict Free Sourcing Initiative (CFSI), an initiative of EICCand GeSI, has released an updated CMRT version 4.0 form to be used for 2015 data and the May 31, 2016 SEC filings.

CFSI developed and maintains the CMRT forms to facilitate the transfer of information through the supply chain regarding mineral country of origin and smelters and refiners being utilized, and provides the CMRT forms to the industry for free.

A press release from CFSI about the CMRT 4.0 release states: "A key update reflected in the CMRT 4.0 is the amendment of the question and answer language in the Declaration to conform to changes adopted by the IPC-1755 Conflict Minerals Data Exchange standard in March 2015.

"In addition, the Smelter Reference List now displays commonly used alternate names for smelters, as well as their city, province and country. These changes will assist CMRT users with confirming the identity of the smelters they are reporting."

The new CMRT 4.0 is available now for download on the CFSI website.

EU Committee Votes to Move Forward With Conflict Minerals Legislation

Yesterday the EU's International Trade Committee voted 22 to 16 to move forward with a draft conflict minerals law requiring certification of EU smelters and refiners importing conflict minerals.

The legislation applies to EU importers of tin, tantalum, tungsten, and gold (3TG) originating from conflict-torn areas. The legislation also lays down conditions for labeling requirements and industry self-certification.

Two parts of the draft were rejected in the vote: an amendment suggesting mandatory certification of all downstream operators was voted down, and a proposal to extend the scope to include other minerals and metals beyond the 3TG minerals was also voted down.

The Committee's overall approving vote sends the legislation to vote by the full Parliament in the upcoming May plenary session.

ECHA Publishes First Annual Report on REACH SVHC Roadmap to 2020

ECHAOn March 24, the European Chemicals Agency (ECHA) published their first Annual Report describing the agency's achievements and progress last year along the SVHC Roadmap to 2020.

The SVHC Roadmap aims to have all relevant substances of very high concern (SVHC) under the EU REACH legislation listed on the SVHC Candidate List by 2020.

This year's report covered the agency's progress from February 2013 through the end of 2014. In conjunction with the report, ECHA announced it would release one Annual Report every year going forward.

According to the Annual Report, hundreds of substances were reviewed in 2014. So far, much of the work has been focused on substances already known to be carcinogenic, mutagenic and toxic for reproduction (CMRs), and on identifying structurally similar substances.

Going forward, ECHA plans to refocus their concentration on identifying new CMRs and expects to propose newharmonized classification and labeling standards in the future.

ECHA is also progressing their work on substances with persistent, bioaccumulative and toxic properties (PBTs). So far, 20 substances with PBTs have been included in the Candidate List.

ECHA SVHCThe European Chemicals Agency (ECHA) has added two substances to the REACH Substances of Very High Concern (SVHC) Candidate List. ECHA is accepting comments by industry stakeholders through April 16 regarding the potential inclusion of these substances.

Stakeholders and members of the public may submit their comments online here.

The candidate substances are:

1) 1,2-benzenedicarboxylic acid, di-C6-10-alkyl esters; 1,2-benzenedicarboxylic acid, mixed decyl and hexyl and octyl diesters with ≥ 0.3% of dihexyl phthalate (EC No. 201-559-5)

2) 5-sec-butyl-2-(2,4-dimethylcyclohex-3-en-1-yl)-5-methyl-1,3-dioxane [1], 5-sec-butyl-2-(4,6-dimethylcyclohex-3-en-1-yl)-5-methyl-1,3-dioxane [2] [covering any of the individual isomers of [1] and [2] or any combination thereof]

House Republicans Urge SEC to Drop Fight Over Conflict Minerals Rule

SEC conflict mineralsCongressional Republicans in the U.S. have sent a letter to the U.S. Securities and Exchange Commission (SEC) urging the SEC to drop their effort to force manufacturers to report whether or not their products are found to be conflict free.

In April 2014, the D.C. Circuit Court of Appeals granted a petition by the SEC for a rehearing on the court's September 2014 decision that struck down provisions of the conflict minerals legislation contained in the Dodd-Frank Act.

The initial court ruling agreed with the appeal by the National Association of Manufacturers and the U.S Chamber of Commerce that the provisions of the legislation requiring manufacturers to declare that their products "have not been found to be DRC conflict free" is a violation of the First Amendment because it implies the manufacturer "has blood on their hands."

The SEC had appealed this decision and a rehearing, which has yet to be held, was granted. But last week, House Financial Services Committee Chairman Jeb Hensarling (R-TX), along with Scott Garrett (R-NJ), Bill Huizenga (R-MI), and Ed Royce (R-CA), sent a letter to the SEC Chair Mary Jo White urging the SEC to abandon the agency's appeal.

The letter asks White to report all the funds and time that have been spent defending the law since 2012. The letter also quotes White's own comments about the conflict minerals legislation not fitting into the SEC's core mandate as an agency.

The SEC has not yet responded to a request for comment by Bloomberg, which first published this story here.

EU Court Makes Decision on REACH SVHC Scope Dispute

european-commissionSince the EU REACH regulation first went into effect in 2007, there has been controversy over the scope of the REACH Substances of Very High Concern (SVHC) list. Does the presence of SVHCs in articles apply to components incorporated in the article or to the whole article?

On February 12, an Advocate General for the European Court of Justice decided that the obligations under REACH for companies to report the use of SVHCs applies to article components, not the whole article.

This is a change from the original REACH legislation, and the 2011 legislation revision which also maintained that the REACH SVHC reporting obligations apply to the entire article. Six EU member states had opposed this in the original legislation and formally asked the EU to expand the scope to article components: Austria, Belgium, Denmark, France, Germany and Sweden.

In 2014, a legal process was launched by two French trade bodies to resolve this issue. The French Council of State then referred the case to the European Court of Justice, where it was finally resolved this week. While the Advocate General's decision is not binding, the European Court of Justice generally follows decisions made by Advocate Generals. The official EU judgment on this decision is expected in the next few months.

Users of Greensoft's REACH compliance process should not have a difficult transition should this judgment become final. GreenSoft recommends collecting full material declaration data for all components because environmental regulations change; REACH SVHC changes every 6 months.

When the full material declaration data is not available, collection of the compliance statement for REACH SVHC is then a must. It will then ensure a well-managed compliance process for REACH SVHC compliance at the product-level or at the component-level for articles. At present, GreenSoft's data collection group is able to collect over 70% of all electronic items in full material declaration data. This leads to maximum flexibility in reporting and the ability to respond to changes quickly.

By maintaining a continuously updated database of component compliance data in a data management system that lets users generate various combinations of aggregated reports, GreenSoft's customers are able to quickly respond to changes in regulations. Over A Dozen EU RoHS Exemption Extension Requests Filed

The IPC Association Connecting Electronics Industries and an industry stakeholders group filed over a dozen extension requests yesterday for RoHS-2 exemptions that are set to expire in 2016.

Under the European Union RoHS-2 Directive, all exemptions have expiration dates. Some of the exemptions set to expire in 2016 arecritical to the electronics manufacturing industry, according to IPC.

IPC states: "Throughout the process, IPC and several member companies provided important technical information in order to ensure the extension requests are robust and scientifically sound. IPC reviewed all extension requests and provided important feedback that resulted in credible material submitted to the EU Commission." 

According to the EU website, exemption requests may be granted in certain circumstances such as when a substitute chemical is scientifically or technically impracticable, unreliable, or unavailable.

The process of approving an exemption extension request may take up to one and a half years. However, the RoHS-2 Directive obligates the EU Commission to make a decision on applications for exemption renewals no later than 6 months before the expiration date of the existing exemption.

Newsweek article: Where Apple Gets the Tantalum for Your iPhone

Newsweek ran an in-depth article yesterday on the source of Tantalum in cellular phones and devices. The article describes the struggle with sourcing conflict minerals that our customers are all too familiar with.

Where Apple Gets the Tantalum for Your iPhone puts Apple in the forefront of the conflict minerals discussion, citing Apple's disclosure of every smelter in its supply chain in February 2014, a first of its kind level of disclosure from a manufacturer this large.

The article also brings up an alarming concern that the Global Witness organization reported on: "much of the tin, tantalum and tungsten [...] are smuggled out of Congo into Rwanda and Burundi for export. Tin and tantalum smuggled into Rwanda is laundered through the country's domestic tagging system and exported as 'clean' Rwandan material."

As we know, tracing 3TG minerals back to their original mine source is incredibly difficult. As Apple co-founder Steve Jobs said in 2010, as quoted in the Newsweek article: "Until someone invents a way to chemically trace minerals from the source mine, it's a very difficult problem."
