UNITED KINGDOM
Enacted in March 2015, the UK Modern Slavery Act (MSA) aims to prevent slavery, servitude, forced labor, and human trafficking all the way through a company’s supply chain.
It applies to any commercial organization with a turnover of £36 million or more that sells goods or services and carries on a business or part of a business in any part of the UK.
Affected companies must prepare a Slavery and Human Trafficking Statement and publish it to their website every financial year. This requires collecting statements from suppliers across the supply chain and conducting risk analyses and audits for high-risk suppliers.
UNITED STATES
US Federal Acquisition Regulation (FAR)
In March 2015, "Ending Trafficking in Persons" provisions were added to the US Federal Acquisition Regulation (FAR). These provisions apply to any companies with US government contracts or sub-contracts that are for services performed outside the United States and with an estimated value exceeding $500,000.
California Transparency in Supply Chains Act
The California Transparency in Supply Chains Act went into effect in January 2012. It applies to any retail seller or manufacturer doing business in California that has annual worldwide gross receipts of more than $100 million.
Both of these regulations require certification statements from affected companies as well as a risk analysis and the collection of similar statements from their suppliers.
CANADA
Fighting Against Forced Labour and Child Labour in Supply Chains Act (Supply Chains Act)
Canada’s Supply Chains Act took effect on January 1, 2024. It mandates that affected organizations submit a report to Canada’s Minister of Public Safety by May 31 each year and publicly post the report both on the organization’s website and Public Safety Canada’s website.
Reports include completing a compulsory questionnaire and detailing the steps taken during the previous financial year to prevent and reduce the risk that forced labour or child labour is used by them or in their supply chains.
